In this tragic case, as a result of inadequate APGAR assessments, our clients’ daughter, baby S, was not noticed to have signs of breathing difficulty until 25 minutes after her birth.

Once the breathing difficulties were identified, a crash team were called and the baby was intubated and taken to the Neonatal Intensive Care Unit, where a diagnoses of Strep B infection was made. Unfortunately, baby S died the following day.

The family were critical of the care in that had the breathing difficulties been noticed earlier, appropriate support could have been given and the baby S’s life saved.

As a result of witnessing the tragic events that unfolded, baby S’s mother developed Post Traumatic Stress Disorder, from which she was expected to make a full recovery with treatment.

Liability was denied by the Hospital Trust and court proceedings were commenced. We were able to settle the claim prior to the case going to Trial, thereby avoiding the trauma of the parents having to re-live events.
