We have been acting for a client (aged 48) who sustained an accident at work in December 2016 causing him a severe hip injury.

Briefly, at the material time, he was employed as a manager for a recycling company. In December 2016, he went to move a waste bailer, when it overbalanced, fell and landed on him.

He had to be admitted to hospital and was advised that he had broken his pelvis. He had to undergo surgery, required a blood transfusion and he was in hospital for over 2 weeks.

It was our case that our client was working in an unsafe environment in that there were a number of breaches of the manual handling regulations all of which contributed to him having his accident.

Fortunately, he has made a good recovery from his injury and the prognosis for the future is encouraging. He was able to continue working although on light duties only. He will have to avoid any heavy manual work in the future although this should not impact on his earning capacity.

A letter of claim was sent to his employer’s insurers and the parties were able to agree upon a settlement without the need to issue proceedings.
